SafeWork SA update to the Regulations for the Portable Long Service Leave Act 2024

Draft Regulations for Portable Long Service Leave now open for public consultation

SafeWork SA has released the draft Regulations for the Portable Long Service Leave Act 2024

The draft Regulations provide further detail on how the scheme will operate, including:

  • How remuneration is defined for the purpose of levy calculations
  • How ordinary weekly pay will be calculated for claims
  • Information for self-employed contractors and working directors
  • Transitional arrangements as the scheme begins

These are key bits of information that will guide how community services employers and workers interact with the scheme from its start date on 1 October 2025.

Who manages the consultation?

This consultation process is being managed entirely by SafeWork SA and the Government of South Australia. While we are sharing this information with you to help keep you informed, we do not control the process.

If you would like to have your say or review the draft in detail, you can do so directly via the SafeWork SA website - https://safework.sa.gov.au/news-and-alerts/public-consultations

Why does this matter?

The Regulations will shape how the new portable long service leave scheme functions in practice - including what you’ll need to report, how levies are calculated, and how worker entitlements will be assessed. Public consultation is your opportunity to understand what’s being proposed and provide feedback.

We’ll continue to keep you updated as more information becomes available. For general updates about the scheme, visit saplsl-community.org.au.

If you have questions about how the scheme works or what’s coming next, our team is here to help - but for anything relating to the draft Regulations, please contact SafeWork SA directly.
